Last updated: 15 September 2026. Unless these Terms of Sale state otherwise, every provision applies unless otherwise agreed in writing.
Article 1. Definitions
Marcottestyle: Marcottestyle bv, a private limited company established at Marcottedreef 20, 2950 Kapellen, Belgium, with company and VAT number BE 0880.453.459, operator of the webshop https://marcottestyle.store (the "Website").
Customer: any natural or legal person who orders or purchases a product from Marcottestyle through the Website, through a project file or by e-mail.
Consumer: a Customer who is a natural person acting for purposes outside his or her trade, business, craft or profession.
Agreement: any sales agreement concluded between Marcottestyle as seller and the Customer as buyer, including agreements concluded through a project file, and any amendments or additions to it.
Product: any product offered for sale by Marcottestyle on the Website, through a project file or by e-mail, including furniture, lighting, fabrics, rugs, curtains and related items.
Made-to-order Product: a Product that is produced only after the order is confirmed, or that is produced to the Customer's specifications (dimensions, wood type, finish, fabric, colour or other personalisation).
Terms of Sale: these general terms and conditions. They apply to every offer, order and Agreement, and to all legal acts between Marcottestyle and the Customer in the execution of an Agreement, unless expressly agreed otherwise in writing. Deviations apply only to the specific Agreement for which they were agreed. The Customer's own general terms and conditions do not apply.
The Terms of Sale are available on the Website at all times and are sent with the order confirmation. The Customer accepts them by placing an order.
Article 2. Offers and conclusion of the Agreement
2.1 All offers on the Website are without obligation. Marcottestyle may withdraw or change an offer at any time before the Agreement is concluded. Obvious errors or mistakes in an offer do not bind Marcottestyle.
2.2 The Agreement is concluded when the Customer completes the ordering process on the Website and Marcottestyle confirms the order by e-mail. For orders through a project file, the Agreement is concluded when the Customer signs the project file or confirms it in writing.
2.3 Marcottestyle may refuse an order or attach conditions to it, for example when the Customer has failed to pay a previous order, when the delivery address is outside the delivery area or when a Product is no longer available. The Customer is informed of this without delay and any amount already paid is refunded.
2.4 Product descriptions, photographs, renders, 3D visualisations, technical drawings, plans, samples and stated dimensions are given in good faith and are indicative. They are not contractual documents. Colours on screen depend on the Customer's screen settings; where a colour number or a fabric or finish reference is stated, that reference is binding, not the rendering on screen. Styling accessories shown on product photographs (cushions, decoration, lighting, plants) are not included unless stated.
2.5 Made-to-order Products are produced only after the order is confirmed and, where applicable, after the Customer has approved the drawing, the colour sample or the fabric sample. A colour or fabric sample sent to the Customer is deemed accepted unless the Customer objects in writing within 5 days of receipt. Once production has started, the specifications can no longer be changed.
2.6 Fabric, wood, colour and material samples that Marcottestyle lends to the Customer remain the property of Marcottestyle and must be returned within 14 days, clean and undamaged. Samples that are not returned, or are returned damaged, are invoiced at the price communicated when the samples were sent. Samples sold as such are not returnable.
2.7 Stock indications on the Website are indicative. If a Product ordered turns out to have a longer waiting time at our maker or supplier, Marcottestyle informs the Customer of the new expected delivery time and the order remains valid; article 6.4 applies. If a Product is definitively no longer available, Marcottestyle may cancel the order for that Product without compensation being due; the Customer is informed and any amount paid for it is refunded within 14 days.
2.8 An order is final only once the payment has been received. Marcottestyle may refuse or cancel an order in case of suspected fraud, a failed payment authorisation or an unpaid previous order.
2.9 Products composed with a configurator on the Website (dimensions, fabric, finish, base or other options chosen by the Customer) are Made-to-order Products. The 3D view and the renders of the configurator are indicative; the chosen options and the stated references are binding.
Article 3. Handmade products, natural materials and dimensions
3.1 Most of our Products are handmade or made to order in small workshops. Dimensions stated on the Website, in a drawing or in a quotation are therefore approximate. A deviation of up to 1 cm per dimension, or up to 2% on dimensions over 100 cm, is inherent to handwork and is not a defect and gives no right to a price reduction, refund or replacement. Where an exact dimension is essential (for example a niche or an alcove), the Customer must state this in writing before the order is confirmed.
3.2 Wood is a natural material. Differences in colour, grain, knots, mineral streaks, small cracks caused by drying, and slight movement or warping of solid wood with changes in temperature and humidity are natural characteristics of the material and are not defects. Wood, oiled and lacquered finishes, textiles, leather and rattan change colour with light and use. Products from the same collection bought at different times may show colour differences.
3.3 Fabrics, velvet and leather may show colour differences compared with the sample, pile marks, creasing, pilling, natural markings on leather and slight differences between dye lots. These are normal characteristics of upholstered furniture and are not defects. Velvet may show pressure marks from packaging; see article 10.6 for care.
3.4 Rugs, curtains and fabrics sold by the metre or made to size may deviate by up to 2% in length and width. Pattern repeat and the direction of pile can cause visible differences between pieces.
3.5 Where Marcottestyle or its makers apply small changes in construction, dimensions, finish or hardware that do not affect the function, appearance or quality of the Product, the Customer accepts these changes.
3.6 Solid wood furniture must be kept in a room with a relative humidity between 45% and 60% and away from underfloor heating, radiators, stoves and fireplaces unless agreed with Marcottestyle beforehand. Cracks, warping or open joints caused by too dry, too humid or too warm conditions are not covered by the warranty.
3.7 Outdoor furniture must be covered or stored when not in use and during winter. Damage or discolouration caused by frost, UV light, salt, moisture, bird droppings or green deposits is not a defect; discolouration and deposits are part of normal maintenance.
3.8 Lighting is delivered without light bulbs unless stated otherwise. Installation must be carried out by a certified electrician. Compatibility with dimmers, smart switches or existing installations is not guaranteed.
3.9 Curtains, blinds and fabrics are always made to measure to the Customer's specifications and are therefore Made-to-order Products, excluded from the right of withdrawal. Fabric cut to length is not returnable. Shrinkage of up to 3% after cleaning, and slight differences in pattern alignment, are normal.
3.10 Rugs may shed wool fibres during the first months and may show creases from transport that disappear within a few weeks. This is not a defect.
Article 4. Prices
4.1 All prices on the Website are in euro (EUR) and include Belgian VAT (21%), unless stated otherwise. Delivery costs are not included in the product price. They depend on the destination and the order value and are shown in the shopping cart and at checkout before payment, in accordance with our shipping policy.
4.2 For deliveries outside the European Union, import duties, customs fees and local taxes may apply. These are not included in our prices and are payable by the Customer.
4.3 Marcottestyle may change its prices at any time. The price applicable to an order is the price shown at the moment the order is placed. A quotation is valid for 30 days unless otherwise agreed in writing; after that period, price increases from our makers or suppliers may be passed on before the order is confirmed.
4.4 If a Product is displayed with an obviously incorrect price, Marcottestyle may cancel or refuse the order within 24 hours after it was placed. The Customer is informed and any amount paid is refunded in full. The Customer may then reorder at the correct price.
4.5 Assembly, installation, placement in a room, vertical transport (stairs, hoists, lifts) and the removal of packaging are not included in the product price unless expressly stated. In Belgium, placement and unpacking are available as paid options; see the shipping policy.
4.6 For deliveries within the European Union, the price includes the VAT of the country of delivery, as shown at checkout. Prices may therefore differ slightly per country of delivery.
4.7 The "price check" on the Website is an invitation to send us a lower price seen elsewhere. Marcottestyle reviews it and decides freely whether and how it responds. It is not a price guarantee and gives no right to a price match or a refund.
Article 5. Payment
5.1 Orders on the Website are paid in full at checkout, using one of the payment methods offered there (among others Visa, Mastercard, Maestro, PayPal and Apple Pay). All transactions are processed over a secure, encrypted connection.
5.2 Made-to-order Products are paid in full in advance. Production starts only after receipt of the full payment, unless otherwise agreed in writing. For orders through a project file, the payment schedule is agreed in writing in the project file.
5.3 If an amount is not paid on its due date, Marcottestyle may suspend production or delivery until payment is received. For business Customers, the legal late-payment interest and compensation under Belgian law apply. For Consumers, the legal rules on late payment apply. A complaint does not suspend the obligation to pay. From the second payment reminder onwards, a fixed administration fee of 15 euro per reminder is charged, without prejudice to the legal interest and compensation.
5.4 Delivered Products remain the property of Marcottestyle until the full price, including any delivery costs and additional charges, has been paid. Until then the Customer may not sell, lend or pledge the Products.
Article 6. Delivery and delivery times
6.1 Delivery takes place at the address the Customer gives when ordering, in the countries listed in our shipping policy. The delivery rates, delivery methods and delivery times are set out in the shipping policy, which forms part of these Terms of Sale.
6.2 Standard delivery is a threshold delivery: to the front door or the ground floor, by one driver. The Customer ensures free access and a parking space for the delivery vehicle and, where a heavy Product requires it, provides an able adult to help carry it inside. Vertical transport is never included. In Belgium, placement in the room of your choice, unpacking and removal of packaging are available as paid options, at the rates shown at checkout and in the shipping policy.
6.3 Delivery times are indicative and are given in good faith. Products in stock are usually delivered within 7 to 14 business days. Made-to-order Products usually take 4 to 18 weeks, depending on the maker and the production time. Production times of our makers, availability of materials, transport and customs formalities can extend the delivery time. Marcottestyle keeps the Customer informed if a delivery date changes. A delay does not entitle the Customer to compensation, to a price reduction or to refuse the delivery.
6.4 If the delivery is more than 30 days late compared with the last delivery date communicated in writing, the Consumer may give Marcottestyle written notice with an additional reasonable period of at least 14 days. If delivery has still not taken place after that period, the Consumer may cancel the order for the delayed Products and receives a refund of the amounts paid for them within 14 days. This does not apply where the delay is caused by the Customer or by force majeure (article 8).
6.5 When an order contains Products with different delivery times, the longest delivery time applies to the whole order, unless a partial delivery is agreed; partial deliveries may carry an additional delivery charge. Marcottestyle may deliver in parts. Each partial delivery may be invoiced separately. Delivery appointments are given as a half-day window; the exact time on the day may shift because of traffic and previous deliveries.
6.6 The Customer must check before ordering that the Products fit through the entrance, staircase, lift and doorways, and that the delivery address is accessible for a delivery vehicle. The Customer must ensure that an adult is present at the agreed delivery time. Additional costs caused by a failed delivery attempt, insufficient access, waiting times of more than 15 minutes, the need for a hoist or lift, or incorrect address details are charged to the Customer. A second delivery attempt is charged at the applicable delivery rate. Return and re-delivery costs caused by incorrect or incomplete address details supplied by the Customer are charged to the Customer.
6.6bis The delivery address can be changed free of charge until dispatch. After dispatch, a change of address is possible only against payment of the additional costs.
6.6ter Deliveries to islands, remote areas, pedestrian or low-traffic zones, low-emission zones and areas that require a permit or that a delivery vehicle cannot reach may carry a surcharge, or the delivery takes place at the nearest point that is accessible. Marcottestyle may also refuse such a delivery before the order is confirmed.
6.6quater Products delivered flat packed are assembled by the Customer with the supplied instructions, unless otherwise agreed in writing. Assembly is not included. Products that have been assembled can no longer be returned under the right of withdrawal.
6.7 If the Customer cannot or does not take delivery within 14 days after Marcottestyle has announced that the Products are ready, Marcottestyle may store the Products at the Customer's expense and risk. Unless otherwise agreed in writing, storage is free for the first 30 days; after that a storage fee of 50 euro per week or part of a week applies. Products that have not been taken within 3 months after the ready notice may be regarded as cancelled by the Customer, and article 9.2 applies.
6.8 Handing over the Products to a person present at the delivery address (including a family member or neighbour) counts as delivery. A delivery document (CMR) signed without remarks is proof that the Products were delivered without visible damage. The risk of loss or damage passes to the Customer at the moment of delivery. The Customer must inspect the Products on delivery. Visible damage or missing items must be noted on the delivery document (CMR) at the moment of delivery. Hidden damage must be reported in writing, with photographs, as soon as possible and preferably within 48 hours of delivery. Products that have been assembled, used or altered can no longer be accepted as damaged on delivery.
6.9 Local pickup is not available. All orders are delivered using one of the delivery methods listed in the shipping policy.
Article 6bis. Projects, installation and site conditions
6bis.1 This article applies to orders through a project file and to installation or placement services, in addition to the other articles.
6bis.2 Removal of packaging, waste and old furniture is not included unless otherwise agreed in writing. Where Marcottestyle removes packaging or waste on a project, this is charged separately according to the volume removed, at the rate stated in the project file or quotation.
6bis.3 The site must be clean, dry, heated, lit, freely accessible and ready for installation on the agreed date, with electricity available. Floors, walls and ceilings must be finished and able to bear the Products. Work of other trades that is not finished, and additional visits, waiting time or storage caused by it, are charged to the Customer.
6bis.4 Installation work may release dust. Marcottestyle is not liable for dust or for damage to items the Customer has not removed or covered. Existing hidden defects of the building (pipes, cables, moisture, uneven floors or walls) that were not disclosed in writing are at the Customer's risk.
6bis.5 Dimensions supplied by the Customer, or taken on site before walls, floors or ceilings are finished, are at the Customer's risk. Marcottestyle measures for production only when the site is ready.
6bis.6 Electrical, plumbing and other technical connections are not included and are carried out by the Customer's own contractor, unless otherwise agreed in writing.
6bis.7 Changes requested after the order confirmation are additional work and are charged at the rates communicated in advance; they may extend the delivery time.
6bis.8 The reduced VAT rate of 6% for renovation works applies only where the legal conditions are met (among others a private dwelling older than 10 years, works performed and invoiced by Marcottestyle). The Customer confirms these conditions in writing and is liable for the difference in VAT, interest and fines if they turn out not to be met.
6bis.9 Marcottestyle may photograph completed projects and use the images for its portfolio, website and social media, without mentioning the name or address of the Customer. The Customer can object to this in writing at any time.
6bis.10 A project quotation is based on the visible condition of the site at the time of the survey. Unforeseen works that become apparent during the execution (among others asbestos, rotten floors or joists, hidden pipes or cables, unstable walls) are additional work and are charged at the rates communicated in advance.
Article 7. Right of withdrawal (Consumers)
7.1 A Consumer may withdraw from an online purchase without giving a reason within 14 calendar days from the day after the Consumer, or a third party designated by the Consumer, takes physical possession of the Products. For orders of several Products delivered separately, the period starts the day after the last Product is received.
7.2 The right of withdrawal does not apply to Made-to-order Products, including furniture in a chosen fabric, wood type, finish or colour, custom dimensions and personalised items, and to sealed goods that are not suitable for return for health or hygiene reasons once unsealed, such as mattresses.
7.3 The procedure, the conditions, the return costs and the refund are described in our returns and refund policy, which forms part of these Terms of Sale and contains the model withdrawal form.
7.4 Business Customers, professional buyers and project or contract orders are excluded from the right of withdrawal.
Article 8. Force majeure
Marcottestyle is not obliged to fulfil any obligation towards the Customer if it is prevented from doing so by circumstances beyond its control that are not attributable to Marcottestyle by law, legal act or generally accepted practice. Such circumstances include, without limitation, failures or delays of makers, suppliers or carriers, shortages of materials, strikes, fire, flooding, epidemics, government measures and malfunctions of the Website, e-mail servers or internet traffic. In that case Marcottestyle may suspend its obligations for the duration of the force majeure or, if it lasts longer than 90 days, cancel the Agreement without compensation being due; amounts already paid for undelivered Products are refunded.
Article 9. Cancellation by the Customer
9.1 An order for Products in stock may be cancelled free of charge until dispatch. After dispatch, the returns and refund policy applies.
9.2 Unless otherwise agreed in writing, a confirmed order for Made-to-order Products cannot be cancelled once production has started. If the Customer nevertheless cancels, or fails to take delivery within the period of article 6.7, Marcottestyle is entitled to a fixed compensation of 30% of the price of the Products not yet in production, and of up to 85% of the price of Products already in production or produced, without prejudice to its right to claim the actual damage if higher. Deposits already paid are set off against this compensation.
9.3 Cancellation must be notified in writing to info@marcottestyle.com.
Article 10. Legal guarantee, warranty and exclusions
10.1 Consumers benefit from the legal guarantee of conformity of 2 years from delivery, in accordance with Belgian law. Some manufacturers additionally offer their own warranty. For professional use, the warranty is limited to 1 year. Showroom models, outlet items and second-hand items are sold in the condition described at the time of sale, and defects known or visible at that time are not covered.
10.2 Within the legal guarantee period, a justified conformity claim is resolved by repair, replacement or, where that is impossible or disproportionate, a price reduction or refund, at no cost to the Consumer. Outside the legal guarantee, transport, call-out and labour costs for repairs are charged at the rates communicated to the Customer in advance.
10.3 The natural characteristics described in article 3, normal wear and tear, breakage of glass or ceramics, and damage caused by non-household or improper use, incorrect assembly by the Customer, accidents, pets, heat sources, cleaning agents, moisture or exposure to sunlight are excluded from the warranty. Fabrics, leather and finishes that are not maintained in accordance with the care instructions are excluded.
10.4 The right to replacement does not apply where the defect can reasonably be repaired.
10.5 A Product may only be returned for warranty work after Marcottestyle has approved the return and communicated the return instructions. If a returned Product shows damage caused by the Customer, the repair and transport costs are charged to the Customer.
10.6 Velour and velvet fabrics may show pressure marks from packaging or use. This is not a defect. Place a lightly damp cloth on the area for 30 minutes, then brush in the direction of the pile with a velvet or nubuck brush and allow to dry. Do not rub the fabric.
10.7 The lifespan of a Product depends on its care. Harsh cleaning agents, pets, jeans studs or other metal accessories, and exposure to sunlight reduce the durability of fabrics and leather. Damage of this kind is not covered by the warranty.
Article 11. Liability
11.1 Marcottestyle is liable only for damage to the Customer or third parties caused by its intent or gross negligence, or for which it is liable under mandatory law. Marcottestyle is not liable for indirect or consequential damage, loss of profit or loss of enjoyment, except where mandatory law provides otherwise.
11.2 Marcottestyle is not liable for damage resulting from the improper use of a Product or its packaging, from incorrect assembly by the Customer, or from a floor, wall or building that is not suitable for the Product.
11.3 Where Marcottestyle is liable, its liability is limited to the amount the Customer paid for the Product concerned, except in the case of intent, gross negligence, or death or bodily injury.
11.4 Nothing in these Terms of Sale limits the rights that Consumers have under mandatory consumer law.
Article 12. Intellectual property
12.1 All intellectual property rights relating to the Products, the Website, texts, photographs, renders, 3D visualisations, plans, drawings and designs belong to Marcottestyle, its makers or other rights holders.
12.2 The Customer may not use, reproduce or pass on these materials without prior written permission from the rights holder. Plans, drawings and 3D visualisations in a project file or quotation are made available solely to evaluate the offer and remain the property of Marcottestyle.
Article 13. Complaints and disputes
13.1 Complaints can be sent to info@marcottestyle.com or to Marcottestyle bv, Marcottedreef 20, 2950 Kapellen, Belgium, preferably with photographs. Marcottestyle answers within 14 days.
13.2 Consumers may also submit a dispute to the Belgian Consumer Ombudsman Service (Consumentenombudsdienst, North Gate II, Koning Albert II-laan 8 bus 1, 1000 Brussels, www.consumentenombudsdienst.be) or through the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Marcottestyle is not a member of a sector dispute committee.
13.3 Belgian law applies to the Agreement and these Terms of Sale, to the exclusion of the Vienna Sales Convention (CISG). For Consumers, the mandatory consumer-protection rules of their country of residence remain applicable.
13.4 Disputes that cannot be resolved amicably are submitted to the competent courts of Antwerp, Belgium, without prejudice to the right of Consumers to bring proceedings before the courts of their place of residence where the law so provides.
Article 14. Promotions
14.1 Promotions are valid for the period stated in the promotion. Unless stated otherwise, they cannot be combined with other offers or discount codes and are limited to two Products per Customer.
14.2 Promotional Products are available while stocks last and cannot be reserved. Discounts do not apply to gift cards, outlet items or Made-to-order Products unless stated otherwise.
14.3 Discount codes are valid for one order, cannot be combined, cannot be applied to an order already placed, do not apply to discounted items or Made-to-order Products, and have no cash value.
Article 15. Website information
Marcottestyle maintains the Website with care, but cannot guarantee that all information is complete and free of errors. Product information, prices, dimensions and delivery costs may change. Marcottestyle may correct incorrect or incomplete information. All dimensions are approximate because of the handmade nature of most Products (article 3).
Article 16. Language and validity
16.1 These Terms of Sale are drawn up in English and are available in other languages for convenience. In case of any difference in interpretation, the English version prevails.
16.2 If any provision of these Terms of Sale is invalid or unenforceable, the remaining provisions remain in full force and the invalid provision is replaced by a valid provision that comes closest to its intent.
